Mr. Rivero, the owner/developer of the 707 parcel has withdrawn his application, in anticipation of passage of Orange County Vision 2050. This too will have a large impact at this site, as per page 92 of the current Vision 2050 draft, his zoning allowance will automatically increase to 21.6 units for market rate housing and 36 for affordable housing. He is currently seeking the affordable housing option because it will allow him the 36 unit density he is seeking. More on this to come, so please stay tuned!!
We received an update that the 707 Woodbury parcel will now be on the BCC agenda for 8/27/2024, with the possibility of being moved out even further. Stay tuned!

Please vote to deny the Silver Palms at Waterford Lakes/707 Woodbury Rd. project. This is an extremely access challenged parcel at an already highly congested intersection, adjacent to two schools.
Location/Safety Concerns
· Project is adjacent to two schools where over 1400 students attend.
- This intersection requires 4 crossing guards daily during school
· It is an very busy intersection where there have been many accidents and many more near- misses that go unreported.
· Developer has no right of way access on Lake Underhill Rd, creating a right turn only ingress/right turn only egress situation on Woodbury Rd. forcing cars to have to make dangerous U-turns to go in the desired direction either entering or exiting
· Parking lots at Discovery Middle School and Waterford Elementary School get completely backed up during a two-hour block in the morning and another two-hour block in the afternoon further hindering access.
· Adding more traffic to an already extremely congested area where hundreds of children are biking and walking to school is a very unsafe idea and puts the children at risk.
- Furthermore this will be a senior apartment complex and emergency vehicle access will be significantly affected during peak school hours due to the volume of traffic at this intersection
· The Location of this complex is in the direct line of sight of the parking lots of both schools as well as areas where the children are congregating outside of school. School safety, and putting a senior apartment complex with no on-site management adjacent to two schools is a potentially dangerous idea.
Community Incompatibility
· Waterford Lakes Community, is already built out, and consists primarily of single-family homes. The roads have become extremely congested and cannot handle existing traffic, particularly during peak hours
· Subdivisions in Waterford Lakes are zoned for low medium residential with the closest neighborhood to the northwest of the community built out at only 5 homes per acre vs the 20 units per acre on this parcel
· the proposed 3 story apartment complex in this location does not fit in with the family-oriented community of single-story homes.
Additional Concerns
· There is no public transportation within a reasonable pedestrian walkshed. The closest available but stop is almost a mile away. This is a requirement outlined in the Orange County Future Land Use Plan.This distance will be even more of a challenge for a senior population to manage, and the walk includes a sizeable hill on Woodbury Rd. which runs over the 408 Expressway.
· Does not appear to be the appropriate or safe use of this parcel which is right in the heart of the community of Waterford Lakes at its busiest intersection
I hope you strongly consider all of the points above and make a recommendation to deny this access challenged, completely non-cohesive project.

These viewpoints echo the opinion of the majority of the Waterford Lakes Community. I urge you to vote against the rezoning of this parcel from Low-Medium Density Residential (LMDR) to Medium Density Senior Housing (MDR-Senior Housing), for the numerous reasons below:
1. The close proximity to an already very busy intersection, which includes two schools, Discovery Middle School and Waterford Elementary. Hundreds of children walk through this very busy intersection to get to school each day. This is a huge safety concern as there have been numerous accidents and near misses at this intersection.
2. Concerns about access to the parcel since there is only access from Woodbury Rd, making this a right turn in only, and right turn out only situation. This would force entering cars to have to go further south on Woodbury into Eastwood and make a u-turn. Exiting the parcel would also force a U-turn either further up Woodbury on the north side, or on Lake Underhill going east, adding more hazard to an already dangerous intersection where hundreds of school children are present.
3. The entrance/exit point in and out of the complex would be halfway between the current Discovery Middle School entrance/exit and the traffic light at Woodbury and Lake Underhill Rd. The very short distance to the traffic light makes it almost impossible to cross over 3 lanes to make a left out of Waterford Lakes and creates the U-turn situation mentioned above.
4. Emergency vehicle access will also be delayed due to the right turn in/right turn out issue. In addition, should emergency vehicles need to access this parcel during peak school/commuting hours, access will be further hindered due to the extensive traffic congestion that occurs during that time.
5. Lack of accessible transportation within a reasonable distance. At the time the closest bus stop is almost a mile away, which is not consistent with the Orange County Future Land Use Plan.
6. Due to the small parcel size, this senior apartment complex will not have sufficient parking to accommodate its residents AND the additional ancillary services a senior population often requires. Despite being a 55+ community, the majority of drivers aged 55-75 still hold a drivers license and would have more of a traffic impact than the developer is claiming.
7. According to the developer, there will be no on-site security or property management. This creates additional safety concerns within the community and the surrounding areas.
8. Lack of cohesiveness with the rest of the community. The majority of homes surrounding this parcel are single family homes, and putting a 36 unit, three-story senior apartment complex in the very heart of the Waterford Lakes is not cohesive with the rest of the community.
9. Again - Safety concerns due to hundreds of students in the proximity of this complex not only attending school but walking to and from each day. There have already been multiple accidents at this intersection.
Ironically in 2020, when we were fighting this issue, Commissioner Cordero did say that she had a relative who was hit at that intersection, and our district 4 Planning and Zoning commissioner at that time reported getting hit at that intersection as well.

Dear Commissioner,
I have several serious concerns at the proposal of changing the zoning of the property referenced, increasing the density of residents allowed.
The two schools have approximately 1400 students combined attending. Most do not have school bus transportation and therefore are pedestrian or parents drop off. Increasing the traffic in the immediate vicinity of the intersection will increase the danger to the school children of being hit by a car at the beginning and end of the day.
There is an extremely high volume of pedestrians 8-9:30am and 3-4:30pm every school day. Having a driveway approximately 290 feet from the traffic light, as the developer stated, will increase danger to our pedestrian residents.
The line of sight to this high pedestrian area and to the elementary school entrance will allow the renters access to see the children’s daily routes to and from school. This may allow predatory access to our children.
The closest bus route is over 3/4 of mile to this property and the route travels east towards Bithlo, not towards an area with higher employment opportunities.
The developer stated that only minimum building codes will be met, and did not state any intention of cohesion in color or building style to the community. This will lower or depress property values in the Waterford East neighborhoods. Therefore the property taxes available for collection from Waterford Lakes PD will stagnate.
I urge you to vote against the rezoning for this apartment complex.

The Planning and Zoning Commission voted 6-1 in our favor, making a recommendation to deny the zoning increase at 707 Woodbury Rd. We had about 20+ speakers and many from the community in attendance, supporting our cause. This was clearly recognized by the Planning and Zoning Commission. This recommendation will now go to the Board of County Commissioners, who have the final vote, on August 13, 2024.
It was really great to see the community come together, and thank you again to all who attended the meeting, spoke, and wrote your letters of opposition!
Dear Waterford Lakes Residents,
We want to extend our gratitude to the over 100 attendees who joined us at last night’s community meeting regarding the 707 Woodbury Development project. Among the attendees were members of Commissioner Cordero's team, Commissioner Cordero herself, many residents, and members of the Waterford Lakes Community Association (WLCA) Board of Directors.
During the meeting, the developer of the 707 Woodbury Development project addressed community concerns and took questions. Community concerns include but are not limited to, the number of units on such a small plat of land, the lack of on-site property management or security, increased traffic in the area, traffic safety concerns caused by a right-turn-only ingress and right-turn-only egress from the parcel, and many more.
After careful consideration, the WLCA Board of Directors, with the support of our community members, believes that these concerns were not adequately addressed by the property developer and as such, we continue to wholeheartedly oppose this development project.
We want to assure you that the Board of Directors is actively exploring all available options. More information will follow in the coming days and weeks.

History:
As you may be aware, in 2020 the owner of this parcel, located at 707 Woodbury Road, was seeking to build a 63 unit, 4-5 story apartment complex. He withdrew his application at the last minute because Commissioner Cordero said she would not support it, due to a lot of community opposition. This parcel is adjacent to Discovery Middle School and across the street from Waterford Elementary School
He is now reapplying to build 36 attainable senior apartment units on that parcel.
The definition of attainable vs affordable per the Orange County Housing for All Task Force Report in 2019: Attainable = Household Income $83k - $97k vs Affordable = Household Income $26k - $83k
There was a community meeting held at Legacy Middle School on April 17th from 6:00 to 7:00 p.m. that provided more information on the new proposal.
Our community was opposed to the original proposal in 2020, and continues to be opposed to the current proposal for the following reasons:

9. This really is not that different from the original 63 unit proposal in 2020 with regards to the number of rooms. 24 two bedroom apartments, and 12 bedroom apartments is still 60 rentable bedrooms. So we feel that the traffic impact from this will be greater than anticipated.
10. Again - Safety concerns due to hundreds of students in the proximity of this complex not only attending school but walking to and from each day. There have already been multiple accidents at this intersection.
We are NOT against senior housing per se, rather THIS particular location due to the access, traffic, and safety issues.
Ironically in 2020, when we were fighting this issue, Commissioner Cordero did say that she had a relative who was hit at that intersection, and our district 4 Planning and Zoning commissioner at that time reported getting hit at that intersection while on his bike.

The Planning and Zoning meeting took place on July 16, 2020. They made a recommendation of denial with a vote of 5-3. You did an amazing job with sharing your voice. They are still claiming that this is an urban neighborhood and that a 5 story building conforms with the community.

These have been updated to include the details and discussion that took place at the 5/27/2020 meeting. Each of your prior emails were individually read and made a huge impact. Now we need to let the Planning and Zoning Committee know how our community feels about the Apartment Project aka: Gardens at Waterford Park.

Update: Meeting Complete. Mr. Vargas with the DRC has stated that this plan is not compatible with the surrounding neighborhood. He made a motion for a recommendation of denial. Second by Diana. All were in favor. That recommendation will go to the County Commissioners. Zoning will hear the zoning arguments on 7/16. As of now, this issue is set to go before the County Commissioners on 7/28 but that might change. Please continue to email all of the county commissioners and the Mayor to let them know that a 60-foot apartment building does not conform with our community! **Meeting can be viewed through the video at the bottom of the page.

There were between 200 and 300 opposition letters submitted.
Only one resident spoke in support of the project and confirmed her relationship with the developer.

Only proposed access is a right hand turn in and out. Traffic will be forced to make u-turns in Eastwood, or on Lake Underhill Rd. and circle back. This is unsafe, even moreso during school hours.
The complex is not close to public transportation. Picture your parents or grandparents carrying groceries 3/4 mile from the bus stop.
This proposed 3 story building is not cohesive with the community which consists of primarily single family homes.
1. Continue to send your comments to the commissioners and the mayor before the Board of County Commissioners meeting in June. This is when the final vote on this will be. Points to consider are posted on this page.
2. Share this information with your neighnors and friends. It is amazing how many people are still UNAWARE of this project.
